Definitions
Trainee - The person undertaking the training (the terms apply to the person once training has been completed and the person becomes qualified)
Overview
Bee Academy Official Ltd. is a trusted provider of online and face-to-face training offering internationally recognised and insurable courses.
The Parties agree and acknowledge that the Trainee shall offer an independent (self-employed or otherwise) service upon qualification via Bee Academy. Any activity, employment or self-employment is not endorsed by Bee Academy and we take no responsibility for your actions. The Trainee is not employed by Bee Academy.
Course Fees
Course fees must be paid in full prior to commencing your training with Bee Academy. Once you have agreed to purchase the course (by making payment in full or by making your first payment) you will not be refunded for any reason and are responsible for settlement of the course fees in full.
The Bee Academy Brand
As a Trainee qualifying through The Bee Academy, you agree to uphold the Bee Academy brand and its ethos. You agree not to bring the reputation of Bee Academy into disrepute at any time. You have permission to use the Bee Academy logo upon qualification on any documentation/resources/website/social media for positive advertising or sharing your experiences in a positive light.
Upon qualification you will receive a certificate (both in hard format and electronically) and (for our coaching qualifications) a badge in electronic format. You may use this badge on any of your marketing and promotional materials, on social media, on your website and your email.
Communications Agreement
We take no responsibility for any client complaints or grievances against you.
You have the right to charge clients at your chosen rate and to operate within hours that suit you. You will operate on a completely independent/self-employed basis, not as an employee or representative of Bee Academy.
Confidentiality
The Parties to this Agreement may not disclose to any third party, the use of the works engaged by the Trainee with the Company without the other party's written consent. Neither Party may sell, nor disclose with any third party any proprietary or confidential information acquired by them in the course of their engagement with the other, without the written consent of the other party.
Where applicable, the Trainee agrees to return to Bee Academy all confidential documents, records, or any information owned by the company upon the termination of the Agreement. In case of failure to return the confidential documents, records, or information, the trainee shall notify the Company and shall agree on how such information shall be disposed or returned to the Company. The trainee will not disclose any information to others upon termination of the contract.
The trainee agrees to respect the privacy of all members and other Trainees, adhere to GDPR legislation and will not disclose any passwords or other sensitive information provided by Bee Academy (if applicable).
Safety
For the purpose of appearing on our website (applicable to coaches only), all trainees agree to provide full disclosure of their qualifications, insurance, affiliations and DBS data. We recommend you obtain public liability insurance.
Period and Termination
This Contract shall remain effective and enforceable in all cases (a-c):
a) Throughout your training with Bee Academy.
b) For the duration of your supervision (applicable to coaches only, i.e., the duration that your profile is hosted on The Bee Academy website). In this case you also agree to pay and/or maintain your payment to Bee Academy (if applicable). Failure to do so will result in termination of our agreement and your profile will be removed from the website.
c) For the time you use the Bee Academy logo in your practice and on any documentation/website/social media representing your service.
Should any party decide to terminate this Agreement prior the date of maturity, the party shall notify the other at least thirty (30) days prior the termination date.
The contract agreement is renewed on an ongoing basis unless otherwise cancelled.
Representations and Warranties
Bee Academy acknowledges and understands that:
1. The Trainee has the unrestricted right and authority to perform the duties and deliverables that conform to this Agreement; 2. the deliverables by the Trainee is original; 3. all duties and responsibilities by the Trainee is compliant with the applicable laws, rules, and regulations of the UK agreed upon by Parties, to be performed in this Agreement; 4. The work of the Trainee will not contain defamatory, disparaging or offensive content to any product or business, or be involved in any pornographic or be contrary to any religious beliefs.
Should any of the provisions of this Agreement be held invalid by any competent court, the same shall apply only to the said provision and the remaining provisions hereof shall remain valid and enforceable.
Judicial Action
You are not employed by Bee Academy Official Ltd. in any capacity and the work you undertake is entirely at your own risk. You are not entitled to bring any legal action for loss or damage to Bee Academy Official Ltd. To protect yourself and your clients, you should be fully qualified, insured and working withing the law and regulations of your field.
Any action arising from or brought under this Contract shall be filed with the proper courts of UK Law, to the exclusion of all other venues that are hereby expressly and willingly waived by the parties.
By training and qualifying with Bee Academy, you acknowledge and agree to these terms and conditions.
Complaints and Feedback
Complaints must be made in writing to [email protected]. You will be sent our complaints form for completion. Complaints made in any other way will not be acted upon. If you have any feedback for us that will help us to improve our service and your experience, please forward this in writing.
